1. Description of Services

Elevation Brokerage provides informational resources, tools, calculators, and services related to residential mortgages, refinancing, real estate financing, lease-to-own programs, and related products. Some Services may involve third-party applications, embedded content, or links to external sites. 2. No Commitment to Lend; No Guarantee

Nothing on the Site or in the Services constitutes a commitment to lend, an offer or approval of credit, or a guarantee of any interest rate, loan program, term, or eligibility. Rates, programs, and availability are illustrative, subject to change without notice, and depend on factors including creditworthiness, loan-to-value ratio, property type, and applicable law. Any figures produced by calculators or estimators are estimates only and are not an offer, quote, or guarantee. All loans are subject to underwriting review, credit approval, and program eligibility.

3. Eligibility

The Site and Services are intended for users located in the United States. By using the Site or Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Site or Services on behalf of an entity, you represent that you have authority to bind that entity to these Terms.

4. User Accounts and Obligations

To access certain Services you may need to submit information or create an account. You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account. You agree not to use the Site or Services for any unlawful purpose or in any manner that could damage, disable, overburden, or impair the Site.

5. Electronic Communications and Signatures

By using the Site or Services, you consent to receive communications, notices, agreements, disclosures, and other documents from us electronically, including via email, text message, in-app notifications, or postings on the Site. You agree that electronic communications satisfy any legal requirement that such communications be in writing, and that electronic signatures, acceptances, and records are valid and enforceable to the fullest extent permitted by law.

6. Telephone and Text (SMS/MMS) Communications

By providing your phone number and affirmatively opting in (for example, by checking a consent box on a form on our Site), you expressly consent to receive calls and text messages (SMS/MMS) from Elevation Brokerage and those acting on our behalf at the number provided, including messages sent using an automatic telephone dialing system or prerecorded/artificial voice. Consent is not a condition of any purchase or of receiving any service.

• Message types: You may receive messages related to your inquiry, application and account servicing, appointment reminders, customer care, and — where you have opted in — promotional offers and updates.
• Message frequency: Message frequency varies based on your activity and interactions with us.
• Message and data rates: Message and data rates may apply depending on your mobile carrier and plan.
• Opt out: You can cancel text messages at any time by replying STOP to any message. After you send STOP, we will send a one-time confirmation and will stop sending you text messages. You may continue to receive messages for a short period while your request is processed.

• Carriers: Carriers are not liable for delayed or undelivered messages.
• Privacy: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service, is permitted. All other categories of use exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. See our Privacy Policy for details.

7. Data Ownership and Handling

You retain ownership of the data you submit to the Services (“Customer Data”). You grant us a non-exclusive, royalty-free license to use, reproduce, and process Customer Data as necessary to provide and improve the Services and to communicate with you, subject to our Privacy Policy. We handle personal information in accordance with our Privacy Policy and applicable law.

8. User-Generated Content

If you submit content such as documents, messages, reviews, or comments (“User Content”), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display it as reasonably necessary to operate and provide the Services, subject to our Privacy Policy. You are solely responsible for your User Content and represent that you have all rights necessary to submit it.

9. Intellectual Property

The Site and Services, including all text, graphics, logos, trademarks, software, and content (“Content”), are owned by Elevation Brokerage, Roxford Holdings Inc., or their licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Content for your personal, non-commercial use only. You may not copy, modify, distribute, or create derivative works without our prior written consent.

10. Third-Party Content and Links

The Site may contain links to third-party websites, applications, or services (for example, embedded tools, mapping providers, or payment processors). We do not control or endorse these third parties and are not responsible for their content, privacy practices, accuracy, or reliability. Your interactions with third parties are at your own risk and may be governed by their terms and policies.

11. Disclaimers and Warranties

The Site and Services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or uninterrupted use. We do not warrant that the Site will be error-free, secure, or available at all times.

12. Limitation of Liability

To the maximum extent permitted by law, Elevation Brokerage, Roxford Holdings Inc., and their affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits or data, arising from or related to your use of the Site or Services, even if advised of the possibility of such damages.

13. Indemnification

You agree to indemnify, defend, and hold harmless Elevation Brokerage, Roxford Holdings Inc., and their affiliates, officers, directors, employees, agents, and licensors from and against all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Site or Services or your violation of these Terms.

14. Termination

We may suspend or terminate your access to the Site or Services at any time, without notice or liability, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Site and Services ceases immediately. Provisions that by their nature should survive termination will survive.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising under these Terms shall be resolved exclusively through binding arbitration in Harris County, Texas, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. You and we waive any right to a jury trial and to participate in a class action to the extent permitted by law.

16. Changes to These Terms

We may update these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site or Services after any changes constitutes your acceptance of the revised Terms. Please review these Terms periodically.

17. Miscellaneous
